Georgia has passed significant HOA and condominium law updates in recent legislative sessions. Here is a bill-by-bill summary of what changed — and what your board must do to stay compliant.
2024 Legislative Session (eff. July 1, 2024)
Allows condo and homeowners associations to choose any remedy available under their governing documents to cure covenant violations, removing the prior requirement to first exhaust self-help remedies before pursuing other enforcement options.
2026 (pending full implementation)
Requires HOAs to register annually with the Georgia Secretary of State; failure to register prohibits enforcement actions, fines, liens, and foreclosure. Minimum delinquency for foreclosure doubled from $2,000 to $4,000 (assessments only). Homeowners may file complaints with the Secretary of State for hearing by an appointed officer. Section 7 (attorney fees/judicial review) effective July 1, 2026; majority of Act effective January 1, 2027.
