2021 Legislative Session
Amended Missouri's Horizontal Property Act and Planned Communities Act to authorize electronic delivery of association notices and to permit meetings to be conducted by video or telephone conference. The amendment was made permanent and applies to board meetings, committee meetings, and unit owner meetings.
Added § 442.571 RSMo, prohibiting Missouri homeowners associations from adopting or enforcing any covenant, condition, or restriction that prohibits the installation of solar energy equipment on a member's property. Associations may impose reasonable aesthetic standards consistent with the placement and installation requirements of the equipment manufacturer.
2023 Legislative Session
Required Missouri planned community and condominium associations to provide written notice of delinquency by first class and certified mail at least 30 days before recording an assessment lien. The notice must state the total amount delinquent, the date the lien will be recorded if not cured, and the owner's right to dispute the delinquency within the cure period.
Required Missouri community associations to make governing documents — including declarations, bylaws, rules, and budgets — available to all members on request within 10 business days. Associations with websites must post current governing documents and any amendments in a publicly accessible or member-accessible section.
2025 Legislative Session
Established a maximum fine of $100 per violation per day and a cumulative cap of $1,500 per violation for Missouri homeowners associations. Required written notice of violation and a 14-day opportunity to cure before any fine may be assessed. Established a right to a hearing before the board within 21 days of the fine notice if requested in writing by the owner.
Prohibited Missouri homeowners associations and condominium associations from restricting the installation of EV charging equipment in an owner's assigned parking space or garage. Associations may require a licensed electrician, prior board approval within 60 days of application, and owner-maintained liability coverage for the equipment.
