2021 Legislative Session
Amended Business Corporation Law §602 to allow co-op boards to hold annual and board meetings by electronic communication in the board's sole discretion, permanently (not just during COVID-19 emergency).
2024 Legislative Session
Buildings over 25,000 sq. ft. in New York City — including co-ops and condominiums — are subject to greenhouse gas emissions caps starting in 2024. First annual emissions compliance reports were due May 1, 2025. Non-compliant buildings face significant annual fines.
Enacted federally in 2021, implemented in 2024 — co-ops, condo associations, and HOAs may qualify as reporting companies required to disclose beneficial ownership to FinCEN. Enforcement has been paused for many entities per 2025 court orders; associations should consult counsel on current status.
