2021 Legislative Session

Chapter 67ORS 93.270 Governing Document Review

HOAs of planned communities established before September 1, 2021 were required to review their declarations and bylaws by December 31, 2024 and amend documents to remove any restrictions not permitted under ORS 93.270 (discriminatory and otherwise invalid deed restrictions).

2023 Legislative Session

Chapter 223Extended Compliance Deadline

Extended the compliance deadlines from the 2021 act, giving associations additional time to complete the governing document review and amendment process required under ORS 93.270.

2025 Legislative Session (eff. Jan 1, 2026)

HB 3746Construction Defect Reform & Moisture Inspections

Shortened the construction defect repose period for planned communities and condominiums from 10 years to 7 years. Multifamily condo projects must schedule moisture-intrusion inspections at years 2 and 6 after substantial completion and report results to unit owners.
