Texas has passed significant HOA and condominium law updates in recent legislative sessions. Here is a bill-by-bill summary of what changed — and what your board must do to stay compliant.

2021 — 87th Legislature

SB 1588Landmark HOA Omnibus Bill

The most comprehensive HOA reform in Texas history. Extended delinquency cure window from 30 to 45 days, capped resale certificate fees at $375 ($75 for updates), required HOAs with 40+ lots to separate board members from the Architectural Review Committee, mandated written ARC denial reasons, gave homeowners the right to sue in Justice Court for violations up to $20,000, and required governing document websites for HOAs with 40+ lots and COAs with 60+ units.

HB 3571Security Measures Protection

Prohibits HOAs from adopting or enforcing restrictions that prevent homeowners from installing security cameras, motion detectors, or perimeter fencing (Section 202.023).

2023 — 88th Legislature

HB 614Required Fine Schedule & Enforcement Policy

Effective January 1, 2024 — HOAs authorized to levy fines must adopt a written enforcement policy listing violation categories, a fine schedule, and hearing rights. Must be posted on the website or mailed annually (Section 209.0060).

HB 886Two Delinquency Notices Before Assessment Lien

Effective September 1, 2023 — Before recording an assessment lien, HOAs must send a first notice by mail or email, wait 30 days, send a second notice by certified mail, then wait 90 more days. Minimum timeline: 120+ days (Section 209.0094).

HB 1193Section 8 & Housing Assistance Vouchers

Effective September 1, 2023 — HOAs may not restrict owners from renting to tenants who pay with Section 8 vouchers, federal/state housing assistance, or nonprofit rental subsidies (Section 202.024).

2025 — 89th Legislature

SB 2629Electronic Voting Required

Effective September 1, 2025 — HOAs and COAs must offer at least one of: electronic ballot, absentee ballot, or proxy vote. COA meetings may now be held electronically or telephonically.

SB 711ARC Reform, COA Websites & Management Certificates

Effective September 1, 2025 — HOAs with 40+ lots must solicit ARC candidates via formal notice (10-day minimum). COAs with 60+ units or under management contract must maintain a governing document website and update management certificates within 30 days of any change, filing with TREC within 7 days of recording.

HB 621Political Candidate Events in Common Areas

Effective September 1, 2025 — HOAs may not prohibit owners from inviting elected officials or political candidates to meet in common areas (Section 202.013).

HB 517Brown Grass Suspension During Water Restrictions

Effective September 1, 2025 — HOAs must suspend green vegetation enforcement during any residential watering restriction, plus 60 days after restrictions lift (Section 202.008).
