Boards may now hold meetings by video conference provided a quorum can fully participate and all required notices are delivered at least 10 days in advance.

SB 148Assessment Lien Priority Clarification

Clarified the lien priority of condominium association assessments relative to first mortgages in Alabama, codifying that unpaid assessments constitute a lien on the unit and confirming the association's right to pursue collection through judicial foreclosure following proper statutory notice.

2023 Legislative Session

HB 399HOA Foreclosure Notice Requirement

Requires Alabama homeowners associations to provide written notice by certified mail at least 30 days before initiating foreclosure proceedings for unpaid assessments. The notice must itemize all amounts owed and inform the homeowner of the right to cure the delinquency within the notice period.
