2022 Legislative Session

HB 913Electronic Notice and Meeting Authority

Amended the Mississippi Condominium Act to authorize electronic delivery of all required notices and to permit board meetings to be conducted by video conference or telephone conference. Unit owners who provide an electronic address and consent in writing are deemed to have consented to electronic notice for all association communications.

SB 2718Solar Energy Rights

Enacted Miss. Code § 89-9-14, prohibiting Mississippi homeowners associations and condominium associations from adopting or enforcing any covenant, condition, or restriction that prohibits or unreasonably restricts the installation of solar energy systems. Associations may impose reasonable placement standards that do not increase costs or materially reduce energy output.

2023 Legislative Session

HB 1154Assessment Lien — Collections Procedure

Established a statutory pre-lien notice requirement for Mississippi condominium and planned community associations: a 30-day written notice by certified mail itemizing all amounts due must be sent before recording a lien. The notice must include information about the owner's right to dispute the assessment and request a hearing before the board.

SB 2362Vendor and Contract Disclosure

Required Mississippi association boards to disclose to members any contract with a vendor in which a board member or the management company has a financial interest. Conflicts of interest must be disclosed at the meeting where the contract is approved and recorded in the meeting minutes. Contracts entered in violation of this provision are voidable.

2024 Legislative Session

HB 499Coastal Community Structural Inspection

Required Mississippi condominium associations in coastal counties (Harrison, Hancock, and Jackson) to commission structural integrity inspections of buildings over 3 stories or more than 20 years old by a licensed structural engineer. Initial inspections were due by January 1, 2026, with reinspection every 5 years thereafter. Reports must be disclosed to all owners and retained for 10 years.

SB 2811EV Charging Rights for Unit Owners

Prohibited Mississippi homeowners associations and condominium associations from adopting or enforcing restrictions that prohibit the installation of EV charging equipment in assigned parking spaces. Associations may require compliance with applicable electrical codes, licensed installation, and that the owner carry liability insurance for the equipment.
