North Dakota has passed significant HOA and condominium law updates in recent legislative sessions. Here is a bill-by-bill summary of what changed — and what your board must do to stay compliant.
2021 Legislative Session
Amended the North Dakota Condominium Act and common interest community statutes to authorize electronic delivery of required notices and to permit board meetings and unit owner meetings to be conducted by video conference or telephone conference. Remote participation counts toward quorum. Boards must provide electronic meeting access instructions at least 48 hours before the meeting.
2023 Legislative Session
Added NDCC § 47-05-08, prohibiting North Dakota homeowners associations from adopting or enforcing any covenant, condition, or restriction that prohibits the installation of solar energy equipment. Associations may impose placement standards that do not increase cost by more than 5% or reduce system output by more than 10%.
Established a 30-day pre-lien notice requirement for North Dakota common interest community associations. Notice must be by certified mail and must itemize all amounts due. Association attorney fees may not be added to the delinquency before the cure period expires without payment.
2025 Legislative Session
Required North Dakota common interest community associations with 20 or more units to provide members with an annual financial disclosure including a balance sheet, income statement, reserve fund summary, and budget vs. actuals report. Disclosure must be provided within 120 days of fiscal year end and must be made available to members electronically on request.
Required North Dakota community associations to provide written notice of violation and a 14-day opportunity to cure before imposing any fine. Established a right to a board hearing within 21 days of the fine notice. Fines may not accrue during the pendency of a timely requested hearing.
