Florida HB 1203 (Ch. 2024-221): HOA Director Training, Online Records and Fines

10 min read·October 26, 2026·Krishna Yalamanchi

HB 1203 (2024) added HOA director training, website records for 100+ parcels, fine hearing steps and vehicle rules. Effective 7/1/2024; website duty 1/1/2025.

Quick Answer

CS/CS/HB 1203 (2024), "Homeowners' Associations," is Florida's 2024 HOA reform. It added director education, a records website or app duty for associations with 100 or more parcels, record retention, criminal penalties, new fine hearing procedures, limits on rules for items not visible from the street, vehicle and contractor protections, and audited financials for 1,000 or more parcels. It became Chapter 2024-221 after the Governor approved it on May 31, 2024. The bill takes effect July 1, 2024, and the Senate summary says the website duty begins January 1, 2025.

What the Law Says

We read the Senate bill page, bill history and statute citations, and the Regulated Industries Committee bill summary. We did not read the enrolled text. Where this page names a section number, it is from the bill's citations table; the details come from the summary.

Community association managers

CAMs and CAM firms must annually attend at least one member or board meeting, give members the contact person, contact information and hours of availability, give members on request a copy of the management contract, complete at least 10 hours of continuing education annually, and complete at least five hours every two years on HOA matters, three of them on recordkeeping.

Official records

  • Effective January 1, 2025, associations with 100 or more parcels must keep a digital copy of specified official records available for download on a website or through a mobile application.
  • A subpoena from law enforcement must be answered within five days (the summary also says five business days in a second passage); the association must assist law enforcement to the extent permissible by law.
  • Official records must be kept at least seven years unless the governing documents require longer.

Criminal provisions

  • Second degree misdemeanor: knowingly, willfully and repeatedly (two or more times in 12 months) violating specified records inspection and copying requirements with intent to harm the association or members.
  • First degree misdemeanor: knowingly and intentionally defacing or destroying required accounting records, or failing to create or maintain them, with intent to harm; and expanded fraudulent voting offenses, including aiding, conspiring, or helping an offender avoid detection.
  • Third degree felony: willfully refusing to produce association records to avoid or escape detection, arrest, trial or punishment for a crime; and an officer, director or manager knowingly soliciting, offering to accept or accepting a kickback. (The summary words this item as applying to "a condominium association," even though this is an HOA bill. Our reading is that it is a drafting slip in the summary; confirm the statute text.)
  • An officer or director charged with a criminal violation under Chapter 720 "must be removed from office and a vacancy declared."

Financial reporting and accounting

  • Associations with 1,000 or more parcels must have audited financial statements.
  • No reduction in the type of financial statement for consecutive years.
  • A parcel owner may make a written request for a detailed accounting of amounts owed. If the association does not provide it within 15 business days, outstanding fines of the requester are waived if the fine is more than 30 days past due and the association did not give prior written notice of the fines. An owner may not request another accounting within 90 days.
  • Only simple interest, not compound interest, may accrue on unpaid assessments and installments.

Director education

A newly elected or appointed director must, within 90 days, submit a certificate of completing the educational curriculum, which must cover financial literacy and transparency, recordkeeping, levying fines, and notice and meeting requirements. Directors of associations with fewer than 2,500 parcels must complete at least four hours of continuing education annually. Those with 2,500 or more parcels must complete at least eight hours.

Covenants, architectural review and parking

  • An association or architectural or similar committee denying a construction request must give written notice of the rule or covenant relied on.
  • It may not limit the interior of a structure or require review of HVAC, refrigeration, heating or ventilating systems not visible from the parcel's frontage, an adjacent parcel, common area or community golf course, if a substantially similar system was previously approved.
  • It may not prevent vegetable gardens and clotheslines in areas not visible from those places.
  • Associations may not prohibit parking of a personal vehicle (including a pickup truck) in the owner's driveway or other area where the owner has a right to park, a work vehicle that is not a commercial motor vehicle in the driveway, or an assigned first responder vehicle on public roads or rights-of-way within the association.
  • Governing documents may not prohibit inviting, hiring or admitting a contractor or worker solely because they are not on a preferred vendor list or lack a professional or occupational license, or operating a vehicle in conformance with state traffic laws unless it is a commercial motor vehicle.

Fines, suspensions and liens

  • The 14-day notice of the right to a hearing before a committee must be in writing.
  • The hearing must be held within 90 days of the notice and may be held by telephone or electronic means.
  • Written findings, including the date the fine must be paid or the suspension fulfilled, must be provided within seven days of the hearing.
  • The payment date must be at least 30 days after delivery of the written notice of the committee's decision.
  • No attorney fees and costs may be based on board actions before the payment date. If the violation is not cured or the fine is not paid, reasonable fees and costs may be awarded to the association but may not begin to accrue until after the payment date or after the appeal time has expired.
  • No fine or suspension for leaving garbage receptacles at the curb or end of the driveway less than 24 hours before or after the designated collection time, or for holiday decorations or lights left up longer than the governing documents allow unless they stay up more than one week after written notice.

Electronic voting

Members may consent to electronic voting by electronic means; prior law required written consent.

What This Means in Practice

For boards

  • Count parcels. The 100-parcel website duty, the 1,000-parcel audit duty and the 2,500-parcel education hours each turn on that number.
  • Rebuild fine procedures around the written 14-day notice, 90-day hearing window, seven-day findings and 30-day payment date.
  • Audit rules that review interiors or hidden HVAC equipment, ban pickup trucks in driveways, or require preferred vendors.
  • Set a 15-business-day accounting response process.
  • Our reading: the summary's second subpoena passage says "five business days" while the first says "five days." Use five business days as the conservative planning period until counsel confirms the statute text.

For owners

You can request a written accounting of amounts owed, benefit from notice-and-hearing steps before fines, and expect protections on garbage cans, holiday decorations, gardens, clotheslines, driveway parking and contractor choice.

What we did not verify

  • The statutory wording behind each summary point, including how "reasonably and equitably" applies to architectural standards (the bill title says an association must apply and enforce certain standards that way).
  • Whether anything outside the summary affects fines, such as dollar caps. The summary does not address caps, and we did not read § 720.305 for this page.
  • Any split dates beyond the January 1, 2025 website date.
