HB 1203 — Landmark HOA Accountability Law (Effective July 1, 2024)
HB 1203 was the most sweeping HOA reform Florida had seen in a generation. Every Florida HOA board needs to understand its requirements:
- **Board education:** Board directors must complete a 4-hour state-approved education course within 90 days of election, plus annual continuing education.
- **Online portals:** HOAs with 100 or more parcels must maintain an online member portal by January 1, 2025.
- **Fine caps:** Fines are now capped at $100 per violation.
- **Pickup truck protection:** HOAs may not prohibit homeowners from parking pickup trucks in their own driveways.
- **Debit card prohibition:** Debit cards may not be used for association accounts.
- **Criminal penalties:** Knowingly failing to provide required records access is a criminal offense.
- **Audited financials:** Associations with 1,000 or more parcels must obtain audited financial statements.
